Contested Divorce Case Withdraw

I filed contested divorce notice served to my wife she did not appear to the court it is in petitioner evidence stage now I want to withdraw the case should both of them should appear in court and sign or only I can go to court and withdraw the case.

welli, it appears that your wife has taken notice sent by the court on your petition. Since you alone filed the case you are at all liberty to withdrawa it without the consent or appearance of your wife.

If you want to withdraw the case you alone can file an application for withdrawal of divorce case. You can file a Memo Application in the same court where Divorce Application was being filed, and state the reasons for withdrawal of the divorce petition they may approve the withdrawal of the petition.

okay I understood your question you filed case divorce do you want divorce you can proceed in the court she is experts so will get experts divorce very soon it was so nen fit to you and one more think you do not want divorce so you only go to court and file a memo of wihdrwal with your advocate okay then once you have to file a divorce and withdrew then again you did not file contested case but do you want again you have to file a chance is only meatual divorce okay that's will thank you

A. You can withdraw your divorce petition at any time by filing a request with the court concerned. Your spouse may not object if he/she contests the divorce petition.
