Child visitation demand of husband by using child as a pawn

01-May-2024 (In Divorce Law)
Have filed divorce suit against husband u/s 13(1)(ia). He has filed custody case u/s 26. We are separated since April 2020 after he asked me not to stay in his house . He did not visit me and 2 year old daughter. But after my suit he is seeking visitation rights. Court has permitted daily VC and fortnightly physical meeting in hotel. How to avoid.

well when the case is going on and some relief had been claims by him through the court so you can't deny them but you can only challenge them in the court itself. secondly when the cases are going on so you must have hired an advocate for yourself

As per section 6(a) of Hindu Minority and Guardianship Act the custody of the minor who has not completed the age of 5 years shall remain with the mother. So he cannot demand custodian rights. And if his behaviour is intolerable towards you then you can always file a petition under section 125 CrPC to claim maintenance for yourself as well as for your minor daughter. For more legal assistance I am just a call away.

To assist you, it is imperative that you communicate us the wrong caused to you through his visitation rights. Needless to say, the child did not choose this dispute and to curb the rights of the child being raised in the environment of love and kindness, visitation rights are granted.

Seek a detailed legal consultation from an advocate. Second opinion might help you. So far as visitation rights are concerned it is upto the discretion of the court, however it can be refused or altered also provided there is a harm to the child due to his behaviour
