How can a power of attorney be cancelled.

i have give General Power of Attorney to my Cousin around 8 months ago. as i am not available in the country. i have included 8 properties and my bank accounts. last month i came back to india and came to know that. i receive rent from 6 properties and i have to loan on other 2 properties. so he is taking all the rent and not paying any emi from last 8 months. So when i contacted him to cancel the power of attorney he is not willing to do that. so How can i cancel the Power of attorney.

If the general power of attorney is not registered then a lawyer notice is sufficient to the attorney to revoke.
In case it is a registered power of attorney then you have to again execute a revocation of power of attorney and same shall be registered and one copy has to send the attorney.
If attorney done anything beyond the powers granted to him then you may file a civil case and may recover the amount miss appropriate by attorney

A power of attorney holder can cancel the power of attorney at his discretion.
He need not inform the holder of the cancellation.
If it is a registered power of attorney , you should file a cancellation deed at sub-registrar office.
Also if the monies involved are more than Rs10lakh, it is recommended that you issue a news paper advertisement (1 english and 1 telugu) about the cancellation of the power of attorney.
Also you need to issue individual notices to your tenants and banks that the power of attorney is cancelled and henceforth you will not be liable for attorney holder's actions.

It is not too difficult, you have two options first one you make revoke the power of attorney by submitting cancelation /revocation deed to sub register or you may give another power of attorney to other person on the same properties the first one automatically seized

it depends upon the state you lived in you can singly approach the registrar for cancellation of document or else you can file suit in civil court for cancellation of the above document and also for recovery of the amount to be received from him make sure that all parties are pleaded then only you can save

You can cancel the GPA through deed of revocation / cancellation if GPA was registered then the deed of cancellation/revocation must be registered with the Register and by issuing public notice e.g. news paper ad about revocation of GPA. Once these steps are done, intimate your cousin that power of attorney given to him is no longer valid. You don’t need his permission to cancel GPA given it to him. Good Luck.
