A worker cannot work for more than forty-eight hours in any week and nine hours in any day. With this regard there are various provisions given in Factories Act (Sections 51,54) and Delhi Shops and Establishment Act (Section 8). The worker/employee however, must under no circumstances can work for more than 54 hours for the week depending on the work.
Yes You can approach labor court in case you are working for more than the prescribed working hours. But for that it is necessary for you to fall under the definition of worker or employee as defined under Factories Act and Shops & Establishment Act. So it depends upon facts, such as the post you are working at, salary you are receiving, nature of your job and company you are working in. Besides, companies also have their own working hours and leave policies.

I have seen in many cases that employees in private sector often have to work overtime, past their working hours to increase productivity and company's target. According to Minimum Wages Act, 1948 specifies about the working hours under the rule 20 to 25 that the number of work hours in a day should not exceed 9 hours for an adult. Please understand that in private sector the working hours and timings are stipulated by the employer in company's HR policy drafted accordance with the overtime rules in India. You can file a case against your boss if he or she stretch timings and also claim overtime.

In India, the maximum working hours for employees in the private sector are governed by labor laws, primarily the Factories Act, 1948, and the Shops and Establishment Acts of individual states. Here are the key points regarding working hours in India for private companies as per the law:
  1. Maximum Weekly Working Hours: According to the Factories Act, 1948, adult workers (those who have completed 18 years of age) cannot work for more than 48 hours in a week. This is inclusive of regular working days and any overtime.
  2. Daily Working Hours: The law stipulates that an adult worker cannot work for more than 9 hours in a single day. This includes regular working hours and overtime.
  3. Overtime: If an employee works beyond the prescribed daily or weekly hours, they are entitled to overtime pay. Overtime pay is usually double the regular wages.
  4. Female Employee Restrictions: Special provisions exist for female employees. They cannot be required or allowed to work in a factory between 7:00 PM and 6:00 AM.
  5. Weekly Off: Employees are entitled to one day off in a week. This is typically a Sunday, but it can vary based on the establishment's policies.
  6. State-Specific Laws: In addition to the Factories Act, individual states may have their Shops and Establishment Acts that define working hours for businesses such as offices, shops, and commercial establishments. These laws can vary from state to state.
It's important to note that the proposed increase in working hours to 12 hours per day mentioned in the search results did not become law and the weekly working hour limit remains at 48 hours.

The new labour laws stipulate that a working day is 12 hours long, and a weekly work week is 48 hours. This means that factories or companies can work for a whole week. Overtime has increased across all sectors from 50 to up to 125 extra hours each quarter.
