Can a corporate hospital force a doctor to work 48 hrs a week

29-Jun-2023 (In Labour & Service Law)
I work in a corporate hospital. For the past year, I have been working approx 42 hours a week. This includes 7 to 8 shifts at night of 12 hours duration, and 12 to 13 day shifts of 6 hours duration. My contract does not state the minimum or maximum number of hours that I should work. Now, due to a lack of doctors, the management is insisting that I work minimum 48 hours a week. They are not recruiting new doctors and trying to maximise the use of the doctors available. Can they do this? Can they insist on this 48 hours a week? Is there something I can do? Is there a minimum number of hours that I need to work?

As per law the fixed working hour is 8 hours per day. As you have mentioned due to lack of sufficient doctors your management has insisted you to work for additional hours that you have to discuss with them and sort out or look out for the other option where you can firmly discuss about the working hours initially and the same has to be mentioned in your offer letter. Meantime sometimes doctors have to work beyond time limit by considering the seriousness of the patients that is your professional ethics . Anyways discuss about the same with your management you can ask for extra pay or you can even sent legal notice for extracting additional hours of work which may stress you.
