Is it possible to quash a chargesheet?
16-Feb-2023 (In Family Law)
Hello,
My sister-in-law filed a case against my whole family and also the chargesheet is filed by the police in court, names of every accused family member is on chargesheet.
I'm charged under few sections of 354 ipc. Allegations are I clicked nude pictures of her etc.
She used to chat with me like she was my girlfriend or something everynight with some adult talk. And now after some quarrel with my brother and her, she filed case against us. The marriage lasted only 9 months or so.
Can I use these evidences to quash charge sheet filed by police.
Thanks.
Bhajan Lal vs State of Haryana is the key judgment dealing with quashing of criminal proceedings against accused person. if your case falls in the given category, then you can fancy your chances in high court. a careful perusal of chargesheet by expert will only be guiding factor. take expert help.
sorry to know about your situation. FIR and chargesheet can be quashed with the orders of high court under section 482 of criminal procedure code. In your case if you people have decided to amicably solve the dispute then the chances of quashing are much higher than unilaterally contesting it.

Hi, after filing of charge sheet even the FIR can be quashed if no prima facie case is found against you. There are alternative remedy also in Trial Court to escape from the case. If the evidences are in your favour it will be easy to get it quashed or dispose at lower court which will cost effective too.
Yes, you can go for quashing of the FIR with strong grounds, please share the copy of charge sheet so
It can be read and given better guidance for quashing.
The grounds mentioned by you are not adequate proof and can also be used against you, so share the brief about your case, FIR Copy and Charge sheet as well.

The allegations which you mentioned are very serious in nature, we need to check and read complete file in order to tell you accurately, generally FIR can be quashed if we have very conclusive evidences that these allegations are wrong, morever these whatsapp chats and communication are helpful for us in order to get bail and acquital of the case in wrong run, but if you want to create pressure it is advisable to go for FIR quashment. For more detailled and accurate discussion you cqn contact me for the same.
