Mere husband ne DV ki. complain kiya hai jo pata mahi thaa muje our ghar chodke chale gye juth bolke fir complain ki muje pese nahi dete me rent par rahti hu bole ki ghar khali karde chalija myje divorce chahiye meri age 47 hai .

Hello you can obtain divorce on the basis of desertion ground under Hindu marriage Act 1955 and you should file a petition in Family Court of your jurisdiction for decree and dissolution of marriage , your husband will be summoned for facing proceedings

Q: 498A,504,506,34 filed by wife can I quash the case in high court

498A,504,506,34 filed by wife and 1st hearing is in court in Feb 2026 so can I appeal in court to quash the FIR and if the wife does not appear in court and gives her say will the quashing still be possible and is the girls say final to decide the case.And only oral accuses mentioned in chargesheet and in evidence family members name is only mentioned and whole accuses in on my dad only

Hello you quashing after first hearing in HC will not be entertained as the HC will ask you to face the trial in lower court because the charge is framed… filing a quashing petition is not advisable… any appeal at present is not maintainable

respondent did not file reply of main petition n ammendment in contested divorce but her advocate n wife is putting attendance What benifits will I get of her not replying

These situations can give you benefit of ex partee proceedings against your wife and her evidence probably unless the court allows will not be recorded by court . The allegations made by in your petition through your evidence will be proven effectively

Due to wife constantly harassing me and family at home mentally by her we after suggestion with lawyer informed her when she came back from her home to not get in and we will decide through court and after sometime lawyer sent mutual divorce petition to her and after that she filed 498A.Can I now sent her notice for restitution of conjugal right

Restitution of conjugal rights is always available to you even if the FIR is registered against you by wife. The proceedings can be dropped if you and your wife settle the matter in family court then criminal court can give chance to end the 498A proceedings

Hello you can approach high court for quashing when you don’t have any specific allegation against you in FIR especially when no procedural part is missed while dealing with matter being public servant, the benefit of no recovery of evidence can be given to you while quashing FIR
