Wife not willing to stay with husband

Its been 3 years after our marriage. I have one kid. I am working for a salary of 14k in small city in Goa. I have my fathers home so no need to pay rent. Parents r retired and getting old and i hav to look after them. But Wife stay in mumbai in her parents home. She said she will not stay with me. She is telling to purchase flat in Mumbai and search job in mumbai. I cant afford her plans. I love to stay in Goa. Kindly suggest how to go for divorce. And how much alimony i need to pay.

Divorce can be either by filing petition for divorce by mutual consent if wife also agrees for it or otherwise you have to file a petition by mentioning grounds for seeking divorce. The alimony depends on many factors such as expenses of kid, expenses of wife if she is not working, your income and depends.

file for divorce on ground of cruelty, and on the other ground where is supreme court has ruled that forcing husband to leave his parents is also cruelty and you have right to get the divorce on this ground

as far as Alimoney is concern it will be calculated at per your existing salary and assets you hold in your name at that time

If your wife is also willing for divorce, then you both can file for mutual divorce in court as per your personal law. Alimony always depends on your wife. You might not even pay a single penny, if she agrees to that.

you should file proper divorce petition before the concerned jurisdiction court.
then only u are legally separated. Those 20rs stamp paper issues and all some bogus and useless papers..

Assuming that your friend's sister is a Hindu and the marriage was a Hindu marriage, the said marriage that was arranged before the bride attained majority, it becomes the invalid marriage and it cannot be legally accepted as a marriage. Even though it is better to get a court order, given the circumstances, if anybody raises complaint then the husband, his parents, and the girl's parents will be in trouble.
