Violent wife not leaving home. What to do ?

26-Apr-2023 (In Divorce Law)
Dear Sir/Madam, I am married for one year and a victim of domestic violence by my wife from the day one. I have left home with my mother and staying elsewhere. I have requested her for mutual divorce but she is delaying. I know if we go for a contest in court it will take years. I would like to teach her a lesson by forcing her to move out of my house so that I can return to my home. Since it is a rented accomodation and the agreement is with me and landlord only, can I terminate the agreement with one month notice and find a new rented house. Should I lodge FIR against my wife at local PS before changing the house stating that I am unable to live with her? Will that be enough? Kindly advise. Thanks Anirban

The Laws in India are mostly in favour of wives. Police will not believe your complaint as a man and his mother are always seen as violent and wife of the man as victim. Your wife then is living alone in the house that you have taken on rent? is she pregnant ? Is she working ? You tell me answers for these two and I will guide you next.

Sir, please know that you have got married her with expectation. Further you may not be aware as to how to live a marital life.
Okay over is over, you need not to repent. Have suitable mediation and if it fails. Then you can resort to implement your plan.
She may resort to move the court of law for her maintenance etc. You must be in the position to manage.
you can get out of rented house and you can also terminate the contract. Find out whether you can collect back your advanced amount. No need to lodge a report with the police they cannot take any action as she has not committed any cognizable offence.
Before moving to action please have a consultation with an advocate, as your personal hearing is very much needed to give any opinion. Good Luck.

Our High Court of karnataka on last week has ordered husband can file domestic violence against wife also. U go through it further u can terminate rent agreement by issuing notice of cancelled rent agreement as u entered it. So do it
