Q: Transfer of Property in name of parents

My flat in kalyan is register on my name ,my father's name, my mother's name. cost of flat is 52Lac out of which i have paid only 9.5 lac and still home loan is going on. now my mother had died few years back how can i transfer the share of my mother to my dad. and in future when total loan is repaid i want this property to be fully transferred on my father's name.

As you said that flat is in the name of you, your father and mother which means that 3 of you have 1/3 (33%) undivided rights in the said property. If your mother has died intestate ( without making WILL) , then in absence of any other siblings to you , your mother's undivided share in the flat will devolve equally on you and your father. You can release that share by way of registered release deed in favour of your father to make him 2/3 owner of the flat. And your individual share you can gift him after repayment of loan to make him 100% Owner of the said flat.



Q: Change in ownership of a Residential Flat

At present our Flat in a residential building is jointly owned by Myself and My Wife. My Wife wants to change, when she is alive, her ownership in the Flat to Our Son so that the Flat is jointly owned by Myself and Our Son. Can this be done and if yes how?

Since the Flat is jointly owned by you and your wife , naturally both of you have equal share of 50% in it unless otherwise specified in the agreement. Your wife can transfer her undivided share in the said flat to your son by registered gift deed. For registration of gift deed, stamp duty and registration charges are required to be paid as per government rule of the state and city in which your flat is located.



Q: Contest divorce by mutual consent

Is it possible to contest the divorce by mutual consent petition before the 2nd motion citing unfair distribution of wealth and assets. We have already complied with the agreed terms but now I feel I got a raw deal. I was expecting Atleast 50% of the proceeds considering I have earned 100% of it.

You can not contest a mutual consent divorce petition because it is a consent Petition filed by both of you. If you feel that there is unfair distribution of wealth then you may deny your consent for divorce and the court will dismiss the petition. There after, you can file fresh contested divorce petition by giving reason for divorce. And in that petition you can demand fair distribution of wealth and assets.



Q: Gift Deed of property from Mother to Son - Stamp Duty

My Mother wants to gift her flat to me. What are the new rules of paying stamp duty. Do I even have to pay stamp duty on the value of the flat ?

Stamp duty on gift varies from state to state and also depends on how is gifting the property to whom. It is not possible to guide on on your query because you have not mentioned as to where the flat is located which your mother wants to gift you.



Q: Divorce case to handle situation

I had been separated from my husband for the last two years. We had jointly purchased the property and are co-owners of the house, for which I had made the 50% payment to him. He is the first owner. He and my in-laws, without informing me, had shifted to that new house, and till now they have not paid any rent or any maintenance for my 5-year-old daughter. They have all of my and my children's belongings, including jewelry, which they are not willing to provide me back.

Even if you are working and can take care of your daughter, it is the legal responsibility of father to give maintenance to the child. If you want to file for divorce, you can ask for maintenance of your daughter in the said divorce petition. And your 50% share in the property can also be claimed through family court for which you have paid the money. You have many legal options available to you depending on what remedy you want to your matrimonial dispute.
