Q: Personal Property after Divorce Finalization
My divorce was final Aug 12. In the decree, it is stated that he keeps his truck and I keep mine but I have to refi mine within 6 mo or sell it. (bc his name is on it) I started the refi process in Oct because I had to wait to get a new title from the DMV. He is refusing to sign the title and says he is "withdrawing his consent" for me to have my truck. He is dragging this out until Dec 12 which is the 6 mo cut off. I need my vehicle to keep my job but he will not comply with the divorce paperwork.
Advocate Sunilkumar Rajendran answered
If it is mutual divorce you cannot force him to do so. moreover if the truck was bought at your own source of income , prove that and get that vehicle custody or else file a suit before the concernd civil court and get the property auctioned and get money
