Hello, I got married in the year 2018 but my wife left me within a span of six months, in those six months she didn't let me touch her and our marriage was not consumated, so I have filed for annulment of marriage, and in response to this my wife has filed for 498 and domestic violence, and is now leaving the country for further education, will this lengthen the time taken for my case as my wife wants to do the same, I am a Hindu by religion

You can file in High Court for quashing of 498 and DV, stating that it been filed after your filing of Divorce matter, she is just arm twisting and misusing law, and associated false and fake charges against you. You can also file a private complaint with police station that there is a breach of Trust, cheating done against you by your wife and she has been misusing the law against you, her passport should be impounded and she should not be allowed to leave the country till the finalisation of the matter. There can me more points to take action against your wife once the FIR copy is seen and DV plaint is read.So kindly share them

child custody can be acquired but your child is below the age where the custody can easily be given to you so we will have to prove some very valid reason because of which you should be entitled to get the custody of child time duration with respect to child custody can be minimum 15 month to 24 months

Domestic Violence, divorce and 498A all are different and have different effects498A alone should not be registered it should be done with the dowry act too now the main question is whether your sister wants to continue in marriage or not if she wants to continue in marriage than the divorce cant be filed and if she doesn't that we can move for divorce and whereas the matter of Domestic Violence is concern than you can use this to get maintenance and and other protection for your sisterwould suggest please call me so that we can discuss further things

Q: Verbal and physical assault from illegal/private money

I had borrowed some money from a private or illegal money lender. I paid him interest for some time then could not pay him interest and asked for some time for repayment of interest. But i was still unable to pay the same. So then he started verbally abusing me and threatening me for physical assault and then last night he has started Physical assault on me along with some other people.i need help. How can i not let this happen again and what type of case or f.i.r can i file Against him. How can i safe guard myself.

you can file a private complaint and get the money lender punished for the crimethere are many provisions in law wherein you can get justice and court will also give time for repaymentthe money lender will have to prove if is having a money lending license and is he charging the interest as per the lawand if there is any discrepancy he will be punished for that please call me for further discussion

Is adultery law in india has been defuncted? So that means if a husband having an affair with another woman who is widow is not punishable at all? They both are set free to sleep together and do what they want? Is it only ground for divorce even though if the wife of that husband has proofs which state that they have affair still of no use? Is divorce is the only option? Please suggest.

what ever you have stated about is true but you can file a private complaint under 406 stating criminal breach of trust against your wife and including infidelity.you are right that there is only divorce as option but with above criminal case you can get her punished for the cheating youplease contact me for further discussion
