Yes you can apply for the job but you will have to disclose the pendency of the case in the application form . However, you can't join before you are acquitted of the charges and no appeal has been filed against the order of acquittal

Sir,
This is in response to your query regarding applying for a job even when you are already under suspension. There is no bar to apply for any govt. job even when a case is pending against you. The reason behind is that the matter is still pending in the Court or you can say it is sub-judice in the Court. If you had been convicted then there would have been a problem for you, because, most of the departments first ask, if you are ever convicted under any law for crime against women or under any other law, or, is there any criminal case pending against the applicant. And if pending then provide the details and status of the case.
In the present situation, you can apply for the post, but you have to mention in the column about the details of your criminal case which is pending and not decided yet. You can't hide these details, because, if later on you are found guilty and a sentence is awarded against you and you have concealed these details from that deptt. then the concerned deptt. can also take action against you for hiding such material information from it.
So, it would be better for you to reveal all these details of your criminal case. And you can apply for any govt. Job or private job till your case is not decided finally and till the time any concerned deptt. has not made any specific condition regarding any criminal case of any applicant, in which, even, sub-judice cases are kept out from applying.

When a criminal case is pending against an individual, it can have implications for both private and government job appointments. Here's how it may affect job prospects:
  1. Private Job Appointment: In the case of a criminal charge, private employers may conduct background checks on potential employees. If they discover a pending criminal case during the background check, it could influence their decision. The impact on private job appointments may vary depending on the severity of the case and the employer's policies. Serious criminal charges may lead to job rejections.
  2. Government Job Appointment: Government job appointments also involve scrutiny of the candidate's background. If you have a pending criminal case, the appointing authority will assess the nature and seriousness of the charges. Whether it affects your government job appointment can depend on various factors, including the type of job, the stage of the criminal case, and government policies. Some government positions may disqualify individuals with pending criminal cases, while others may consider them on a case-by-case basis.
  3. Nature of the Case: The nature of the criminal case matters. Certain offenses may have a more significant impact on job appointments than others. Serious criminal charges like those involving violence or dishonesty may raise more concerns.
  4. Resolution of the Case: If the criminal case is eventually resolved in your favor with an acquittal or dismissal of charges, it may have a lesser impact on your job prospects. However, the pendency of the case itself can still cause temporary hurdles.
It's essential to note that the impact of a pending criminal case on job appointments can vary by jurisdiction and the specific policies of employers or government agencies. In some cases, individuals may be eligible for employment after the case is resolved in their favor.

You can apply but you must disclose that the case is still pending in your application. You can't apply for the job until you have been acquitted and there hasn't been an appeal filed against the acquittal order.
