quashing the proceedings of FIR/ 498-A

Hello! In 2022, victim filed a complaint and FIR under section 498A, and the case is ongoing in the lower court with a government-provided Public Prosecutor. However, the respondents are prolonging the case, as the main accused is in abroad and the other accused is in India. Now, in 2024, they have filed a petition in the High Court under section 482 to quash the proceedings, and victim received a "show cause notice”. Should victim hire a lawyer? What's the process for victim exactly?

hi yes you need to hire an lawyer to defend on your behalf in high court and need to see the grounds of quash filed by them and the reasons mentioned in it and based on that your lawyer could defend the complaint filed by you

Yes victims need to hire a high court advocate and file a vakalat in high court and the advocate will fight the behalf of the victim and approach us we help you in filing the vakalat and we fight for you in high court....approach us

you have to hire lawyer and respond. public prosecutor of HC will also defend your case, but you can also represent and make strong objections. otherwise court may go against you, and you are not interested or you did not have enough grounds

Yes. victim has to engage an advocate practicing in high court and to show to the satisfaction of the high court that there is a prima facie case against the accused and that the case against accused cannot be quashed
