Pet owners harassment by residents

We own a pet and stay in south Delhi. We take him to a park in colony and let him off leash for sometime for exercise ensuring noone is around and is not harmed. There are other pet owners who have issue with our dog running without leash in the park and have asked us to keep him leashed. We take our pet at a time when noone in colony comes to the park at 8 pm in night. This one family has told us that they will not leave us if our dog is seen without leash. We want to get a legal go ahead on walking our pet if we ensure no inconvenience to anyone and take him at timings alloted. There are no timings alloted for pets in our society so far..so I want to sue both RWA and this family for differential treatment of pet owners and harassment.

certain guidelines have been framed for moving the pets in public place. However, the present issue pertains to the issuance of dedicated timings that may be allotted by your RWA inorder to move your pet freely in the parks.

Hi,
From what you have written it doesn't seem much of differential treatment and more of a concern of other residents. Nevertheless, if you feel there is a differential treatment and harassment you can go for a civil as well as a criminal suit. In civil suit a case of injunction, damages and specific releif can be brought while a criminal harassment can also be brought.

you may call upon the rwa to designate a spot where you can let your pet move without a leash, like there is a designated place where they can defecate. you are raising a valid point that as a pet owner you need to let your pet to be unleashed for some time so that he/ she can socialise, exercise, etc.

Hello, in such case when there is no policy by either MCD or RWA then the rule of reasonableness is followed and in your case member of the society is harassing and creating a fear in your mind. So for that we would suggest to approach Dist Court for getting appropriate directions against the RWA for one time final solution.
