Can I resume my govt job if I am on bail ?

Respected sir, Mujhe district court se ipc 420, 467 me 7 years ka punishment mila hai. Aur me high court se 30.08.2016 se bail par hu. Me 1 state govt. Teacher hu. Mujhe job me vapas nahi liya ja raha hai. Me last 4 months se apne officers ko aneko bar aavedan de chuka hu. Me kya karu ? Kya me govt. Job vapas join kar sakta hu ?

Government jobs dene se pehle kuch niyam sharte rakhti hai apko job dene se pehle bhi aise kisi document par ho sakta hai sign karway honge. Every department has its different rules for appointing a person having any regisstered criminal offence against him
Apko job mil Sakti hai but it needs more Information from you

It is pertinent to note that there is no bar on selection on the ground of pending trial. However, you must reveal fairly the pendency of the criminal case , FIR, arrest and detention (if any) as required in the Attestation Form and Affidavit to be submitted with the Department. As per law, it is for the screening committee to decide whether the pendency of the criminal case would have any bearing on the nature of your post on the basis of the allegations leveled against you in the FIR and the charges(if framed). There are plethora of judgments where the courts (including the Supreme Court) have interfered in the decisions of the departments discharging servicemen only on the pretext of a pending case. Moreover, a judgment delivered by Justice M Katju (Supreme Court) directs the departments to take liberal view in such cases and not to reject the candidature solely on the ground of a pending case

You are on bail but not acquitted and until aapko charges se discharge ni kiya jaega tab tak aap govt jobs ni ker sakte because aapke uper charges aise h jo fraudulent documents se related h under such circumstances no one will be able to trust you. When you will be set free or discharged by high court you can get your job back or can apply for any government job

No you cannot join your service because you were dismissed on account of conviction by court.Tough High Court has granted you bail but it has not set aside the order of the lower court and before law you are still guilty and your dismissal is valid.

Agar apko trial court se punishment ho chuki hai aur uske khilaaf appeal pending hai to apka vibhag apko fir se naukari par rakhne ke liye badhya nahin hai.

Kisi apraadh ke trial ke dauraan jab ki apraadh siddh nahi hua hota hai, karmachari ko naukri par rakha ja sakta hai. Par vibhag suspend bhi kar sakta hai trial ke dauraan.
