Doing Ph.D while working full time job will the degree be valid or not

Dear Sir My friend is doing regular Ph.d course with a job of contract full time primary teacher under state govt.As per service rule his service is for 60 yrs of age.There is no provision of study leave.So he has not taken No objection certificate and study leave from the employer which is mandatory in time of admission as per Ph.d regulation of UGC.He is marking his attendance regularly on teachers attendance register by managing some how the school committee.I am curious to know whether this Ph.d degree will be valid or not ?

the dispute would arise when the attendance for the course would come up. it wont be a valid degree as you cannot be present at both the places and doing 2 things at the very same moment. being it job and studies (regular) and obtaining NOC from the employer is very essential and this can also lead to serious consequences against him.
