Dear Client,
Your Tenant has used your address for the purpose of making an aadhar card, for which you need not worry. However its important that you register you leave and license agreement and also that you do the police verification of the tenant done.

Yes it is improper. The permanent residence address should have been given by him or her as address proof. It can be used against the landlord if the matter goes to court as proof that the intention of the leave and licence was to create "tenancy rights" in which case you can't evict him.

Tenant is bound to provide address where he is residing i.e. on the address where the tenancy rights are created under Tenancy Law. There shall be no any prejudice caused to you as a landlord if he has applied for ADHAR Card by providing address of room or tenement where he is staying. The Terminology 'using my address' is appears to be ambiguous because it may create confusion in the sense that using address of your room where you staying or using address of your room where the tenant is staying in the premises of which you are owner. Be that as it may, in my opinion no prejudice will caused if he has provided address of his room or tenement of which he is tenant. You can ask for photocopy of ADHAR CARD for your satisfaction.

No. Your tenant is not wrong in applying for n Aadhar card using the address of his rented house, as long as his tenancy agreement is in force. It is advised to include a clause in the tenancy agreement to that effect.

Using your address for an Aadhar card without your consent can raise concerns, and it's important to understand the legal aspects of this situation. Here's some information regarding the legality of a tenant applying for an Aadhar card using your address:
  1. Consent: Ideally, a tenant should seek your consent before using your address for official documents like an Aadhar card. Using someone else's address without permission may raise legal and ethical issues.
  2. Rent Agreement: In many cases, tenants may use their rented address for official documents like Aadhar cards. However, they should have a valid rent agreement in place as proof of their residence at that address.
  3. Aadhar Card Address Change: Aadhar cardholders can change their address online through the official UIDAI website. If the tenant has a valid rent agreement, they may use it as proof to update their address.
  4. Tenant Responsibility: It is primarily the responsibility of the tenant to ensure they have the right to use the address and make any necessary updates to official documents.
  5. Legal Action: If a tenant uses your address without permission, you may consider legal action or consult with legal professionals for advice on how to address the situation.
It's crucial to communicate with your tenant and ensure that any use of your address for official documents is done with your consent and in compliance with the law. If you have concerns about this situation, consulting with a legal expert may provide guidance on the appropriate steps to take.
