What if the landlord does not give the original copy of invoice

29-Jul-2023 (In Landlord/Tenant Law)
I paid the amount of rent to the landlord he made an invoice but refused to give me the invoice instead asked me to take a picture or a xerox copy just for evidence that I have paid, and said he is going to destroy the invoice. What does this mean ? He is a landlord of a paying guest.

Even a landlord of a paying guest cannot deny the invoice against which the payments by any tenant he is in receipt of.
The tenant has full right to obtain the copy of the invoices and then make the payment and take receipt of the amount received.
Ideally payments are to be made against the invoices and then the receipt for those payments should be collected from the landlord.

Rent receipts are usually avoided by landlords since it may have tax liability for them and there is no law that compels a landlord to issue the same. There are various reasons why a tenant requires a rent receipt. If it is only for the record purposes that the tenant has tendered rent, I suggest that the rent should be tendered by way of cheques. That is a sufficient proof of payment. Rent receipts can still be disputed but the bank statement cannot. Further to add on, a watsapp message / email can be dropped with the landlord informing him that the tenant has tendered rent as per the rent agreement and a request can be made to acknowledge the same. However, if it is for the purpose of taking some benefit like reimbursement from office, then I suggest that the tenant should change the house.

you have right to get the original receipt , or you can pay him rent by money order/bank draft/cheque . for the proof of your rent paid . In future you can use for evidence in case you need it. you can send him legal notice for not giving the original receipt, if required so ?

One should always ask for original rent reciept. If any dispute comes up between landlord and tenant then the rent recipient will be substantive proof to show the relation of landlord-tenant. Otherwise the tenant won’t succeed in his case. Getting the original rent recipes is the right of landlord.

Sir,
You should send a legal notice to the landlord to give original invoice of the amount paid by you. in the account of rent stated that you are in need to show in your income tax return or to receive the said amount from your employer.
