Builder denying the payment made and not providing the possession

We have done registry of the flat and My father has been giving rest cash payment to builder of 150000rs per month, but he is denying the paymemt made to him of 1 month.. he has provided cash receipt for that month but he has written duplicate on top of it. and now he is demanding 150000rs saying that he has not got that payment.. and the cash receipt which he had given was for the previous month which he thought he had forgotten to give. Now he is not giving possession of the flat and demanding that 150000rs .as he had promised possession of the flat within 18 months.. he has failed so. what should we do?pls help .My religion is hindu

Venerated Sir,
As per your grievance I would like to inform you that you can file notice to the builder first for the sake of possession of flat on the basis of payment. If builder gave you money receipt for payment of that month then it is a proof of payment under Evidence Act. You can also show your bank balance of debited amount which would be a good evidence to show your transfer of money to builder. You have right to file cheating and forgery case against builder for performance of contract.. Feel free to call me for better assistance.

It is a fit case for filing consumer case before the appropriate authority be it District Consumer Forum / Jharkhand State Consumer Commission. Take stern and immediate action. If registry is there, no requirement of any additional payments.
