16-Jun-2023 (In Domestic Violence Law)
I had resumed my marital home after filing DV case on the request of husband. But he continued his Violence. I left his home thereafter. Now I have decided to leave this relationship. I want to offer him mutual divorce with no demands for alimony or interim as I am fed up of the court proceedings as well as do not wish to see his face again. Shall I offer him for Mutual divorce with no demands? I mean since I am not demanding anything will it send any wrong message? I am not having any affair and do not wish to remarry. I just want to concentrate on my individual mental wellbeing and health and career that's why want to get out of this case and relationship ASAP.

hi

in this case you can proceed to file mutual consent divorce petition if your husband agrees.
there's statutory six months cooling period for deciding the divorce decree.
within these six months both parties go through counseling.

this period can be waived off if there are special circumstances.

Even if you want peaceful divorce but the other side also should be ready for it, there are cases when husbands only want to harass their wives and can go to any extant. You need to put first pressure upon him, and there are ways to do that, then he himself will give you divorce.
