Withdrawal of domestic violence post divorce by mutual consent

17-Aug-2023 (In Domestic Violence Law)
In consent terms jointly filed by petitioner and respondent it states that the petioner-wife shall withdraw the domestic violence case on or before the date of final decree of divorce by mutual consent is passed. The same has been recorded in the divorce consent terms in divorce by mutual consent section 13-b application as well. Is there a possibility to persue domestic violence after divorce is finalized?

Not at all. Once things got in writing before court, one cannot move back and she can't file case not only under Domestic Violence Act but under any law as relation got complete full stop and if she does anything else like this you can move with contempt proceedings.

Hi. Since you both have entered into the consent terms the petitioner wife will have to first withdraw the domestic violence matter and then only the divorce can get through. If the petitioner wife does not withdraw then the respondent husband shall not agree to close the mutual consent divorce and you can take a next date for the same. You can connect with me I shall explain the process
