24-Sep-2023 (In Divorce Law)
I have a DVA case going on from last 3yrs...my husband and I are entering into a settlement and supposed to sign a mou and then file mutual Divorce.... please guide how to end the current cases running in the court .... should they be withdrawn or will it have an adverse effects on me later if my husband backs out from the mou signed...pls guide... regards, Pragya 8334889998
you need to deal with it very tactfully, all cases will be withdrawn simultaneously on the day of the final mutual divorce otherwise all cases will go against you and you will be in a bigger mess and it will be very difficult for you to handle the situation.
Don't withdraw the DV case. You can incorporate a clause in the settlement deed or MOU that after obtaining a decree of MCD, the DV case will be withdrawn and neither party to the marriage will press any charges against each other. For any further guidance you can contact me.
