hi,

yes it is really non technical and easy process to gain one sided divorce order from the family court. to make it clear when you file divorce courts usually issues notice to the opposite party for the appearance and when the opposite party is not available court proceeds ex parte against opposite and finally grant exparte divorce.

You can file got mutual divorce and appear in the first motion and he can then give his statement through his parents if you go for mutual divorce. yes u can file divorce petition under HM act .. but have to made solid reason nd proof to prove you divorce petition.. and in this divorce petition u can also.. file maintenance.. and if he gone.. than it become easy..
