Q: Case u/s 318(4) BNS (IPC 420), 319(2) BNS, 66D IT Act

Charges have been framed and case is in prosecution’s evidence stage of trial, complainant has been duped of 86 lakh ruppees, is razinama possible? What is required for that? Accused dosent have 86 lakh ready at the moment but can pay 10-12 lakhs upfront over 2 years accused can pay the whole amount is that possible?

Yes, razinama (compromise) is possible even at the evidence stage, but its effect depends on the nature of the offences. If the sections invoked are compoundable under Section 320 CrPC, compromise before the trial court is possible. However, in most cyber-crime or cheating cases (like under Section 420 IPC, IT Act etc.), offences are non-compoundable, so direct compromise before the trial court is little difficult (descrition of the judge)In such cases, the parties can file a joint petition under Section 482 CrPC before the High Court for quashing of the FIR and proceedings on the basis of settlement. The Court generally permits it if:1. The offence is private in nature (not against society at large).2. The complainant confirms the full settlement or repayment plan.Even if the accused cannot pay the entire ₹86 lakhs at once, a written settlement showing bona fide intent and partial payment (₹10–12 lakhs upfront with balance over time) can be placed before the High Court for consideration during quashing.Quashing of FIR can also be done without compromising but for that i have to go through with your chargesheet first.

2 husband children are living abroad & not in touch frm last 8 years & he wish to adopt my son.. Is there any barrier coz of his children and my former husband consent is there fr adoption but tehsil is denying coz of his children living aborad

You can move the court directly if you are being denied. What is the age of the children abroad? Ideally it should not have any bearing on the adoption but depends on the state and rules. Where are you from?

The first thing to do is send them a written representation seeking unfreeze. Have you received any notice before the freeze? If not you can send them a representation and give proper written explanation. Also submit the same to the bank.

It is best to give a representation to the concerned police department explaining everything so that your obligation is minimised and you don’t have to worry about any adverse action. Even if it is a small amount, it is advisable to provide a proper written representation absolving yourself of any involvement.

Aapko agar violence karke nikala hai to aap apne husband ke against case file kar sakte ho. Agar wo aapko maintain nahi kar raha hai to bhi aap court se application laga ke maintenance ki maan kar sakte ho. Depends on what you want.
