Regarding notice issued by police U/S 41(1)

A fir was filled by Mr.A against Mr B. U/s 420,507,465,468,471,114 IPC.Mr.B is on bail and also filled petition for quashing of FIR in HC.Now on the basis of WhatsApp conversation with Mr B police has issued notice u/s 41 crpc to appear before them.What step should I take

dear client as per your query I can only suggest that if you have got bail then it would be a conditional bail until the filing of the chargesheet 173 and for quashing u/s482 or criminal writ petition must have been filed if police has initiated for 41 then some documents of forgery or evidence has been mentioned contact your lawyer for future paid consultation please contact us with your relevant documents.

hello I got your problem the solution for that is go to the police station with a person who has no involvement in the said case Crime number under the same sections . as your all sections are below 7 years of punishment so under section 41A CRPC police may release you on bail . let us know if you need further any legal assistance or help.

Since Mr. B has been granted bail by the concerned court, the police does not have the right to arrest him.

Also, Section 41 of the CrPC is a mandatory provision which has to be abided by. If you do not appear before the police, then that would be bigger issue.

accused can take relief from the court 438 CrPC for anticipatory bail with interim bill if you will be go for anticipatory with interview police cannot arrest after taking anticipatory, it's session trial.
