Terminating a common wall agreement

My mother and my previous neighbour have signed an agreement that a wall and a pillar built atop as centred to the wall shall be considered common and both can use them. The neighbour who signed the agreement has sold the property to the new neighbour, they have now encroached the entire and wall and pillar,not allowing us to use it. Based on us revisiting our property document,we believe that the land where the common wall and pillar is situated belong to us.How can we terminate the agreement?

all the documents has to be verified only then clear suggestions can be given regarding this issue.
considering that the wall and pillar are built on your land, at first send them a legal notice directing them not to encroach your wall and pillar. if the opposite party has not obliged to the direction in the legal notice, then a suit for injunction restraining the opposite party from utilizing your wall and pillar has to be filed in the court of law
