Neighbor objecting to construction of drain outside my boundary wall

Sir we have 3 katha of land and we are constructing boundary wall and on one side we are constructing a small drain in our land outside the boundary wall but the other land owner is objecting the construction that we are doing in our land they are giving reason that dirty water will give fowl smell fyi let me tell you that the land is empty that the owner is talking about please give suggestion

With due respect I would like to suggest you not to make such petty cases a serious one. Try to make your neighbour understand by telling him the benefits of such act. And if he is not willing to co-operate, build it in your side of the wall OR build a drainage with a lid on it, thus the foul smell will stay away as he had asked.

The objection of obnoxious /foul smell from the drain is a valid point . By constructing drain outside your boundary wall you have made your own position vulnerable . Supposing at later stage your neighbor claims the land where drain is situated and fills it up , the position will be grave and you will not be able to defend your possession .

If you are constructing drain out side the boundary wall over others land then it is definitely illegal. If you you are constructing within the boundary of your land no one can object. However, you must ensure that your drain does not cause any nuisance.

Until and unless the drain is within your well demarcated land there cannot be any complaint from others. But smelly drain can be a point of complaint irrespective of its area. It will even make you feel sick if your area is smelly.

Dear Client,

I have gone thorough you question. If it is outside your boundary wall i.e. your scheduled plot of land there is no possibility of civil suit against your neighbor. But if it on the road side you can take steps. For that you have to provide me the details of your plot schedule.
