What legal step for use of common wall for construction of floor

Hi.. We are started construction for our house which has common wall between us and my neighbor.He has construed 1st floor in his common wall and now when we try to remove the our common wall he is not allowing to remove.Is there any legal action i can take??

Sir,
In your problem please tell me who had built the wall. Even it may be common to both of you, if the deed reflect the wall, then you will become the owner of the wall.

Under such circumstanced you can take injunction against him.

the question is while constructing the compound wall why you are silent or nor objected. This question you need to answer before challenging. Another question why you had not questioned set back area while constructing.

Both parties share the expenses and assets of both parties. If both parties have a part that likes to construct a roof etc. The second party cannot. You cannot stop the other party from laying said roof.
