The amount of stamp paper required for a General Power of Attorney (GPA) can vary based on the state in India where it is executed, as stamp duty rates are determined by state governments. Here's a general guide on the value of stamp paper for a General Power of Attorney:
- Check State-Specific Rates: Each state in India has its own stamp duty rates for legal documents, including General Power of Attorney. It's essential to check the specific rates applicable in your state, as they can vary significantly.
- Calculate the Stamp Duty: Stamp duty for a General Power of Attorney is calculated based on the property value, transaction value, or the consideration involved in the GPA. The rates may also depend on whether it is a residential or commercial property.
- Visit the Local Stamp Office: To determine the exact amount of stamp duty required, visit the local stamp office or the official website of the state's revenue department. They will provide you with the applicable rates and help you calculate the stamp duty.
- Purchase the Stamp Paper: Once you know the required stamp duty amount, purchase non-judicial stamp paper of the corresponding value from an authorized stamp vendor or government office. Ensure that the stamp paper is of the prescribed denomination and is legal in your state.
- Draft the GPA: Draft the General Power of Attorney document, following the legal format and requirements. It should include all necessary details and terms, and it should be signed by both the grantor (the person giving the power) and the agent (the person receiving the power).
- Stamping and Execution: Affix the purchased stamp paper to the GPA document as per legal requirements. Both the grantor and the agent should sign the document in front of witnesses as required by law.
- Registration: Depending on the state, you may also need to register the General Power of Attorney with the local sub-registrar office. Registration involves additional fees, which can vary.
