Yes. Obviously there is evidence of the marriage not only the photocopy also the birth certificate of the child and also the identity proof of the lady. Though The marriage registration is mandatory. But practically it is not necessary to proof she is married and if a married person marry again with any other then the second marriage is void. So I suggest you that firstly the lady take divorce from her present husband then you may marry her.

I do not know which type of Legal Evidence you need to proof of her marriage? Your father and Mother may have no marriage Certificate, But you say that they are married couple, Why? because, Society see that, they live jointly as Husband and Wife and the Son or Daughter came out due to the wed-lock in between them. This is the Proof that they are the marriage Couple.
In your Case, you say the Women have 10 years Boy. My question is whether she is Prostitute Or Kept of a Man. If the Society does not know that, she is a Prostitute or Kept then what is your Problem man to believe that said son take birth due to the valid wed-lock of a man and women.
Prior to marry her Divorce is necessary.

Yes you need to wait for divorce because you have mentioned that she has children, if you marry her now then the marriage will be null and void and you will be punished as per Indian. Penal code provisions

Not at all Dear you cannot marry the women already married, further if some how u married her it be illegal and that won't finish your criminal case, so if u want to save your self then Collect evidence that she is black mailing you, and then fight your case

No. You can not marry this woman,
Because she is married woman till that.
If u want to marry this woman, then she has to file a divorce case against her husband and then after taking divorce she is able to marry any person.
