Action against builder for non-settlement even after sending notice

I have some payment on a builder from delhi worked at zirakpur work done construction i send a legal notice to the builder on 18/04/2014 in which they reply for settlement.but no settlement made. please tell me how i proceed. the case is for 3200000/- lakh rupees and i have no money for court fees

Dear first of all engage an Advocate and file the suit immediately as I think that limitation to file the case is three years from date of breach of contract. The court fee required on suit is mandatory, although it can be postpone for some time.

Dear sir
In a legal notice you demanded amount but in reply what he admitted .if he admitted payment you can file suit for recovery of your amount.you can file criminal complaint to police because of his bad intention .

Go to consumer forum in person, make a simple complaint under section 12 of consumer protection act 1986 and file it in District consumer forum with your affidavit attested from oth commissioner (charge 50-100) and with postal order

There is a limitation of three years for the recovery of the amount from the date of completion of the work. Then in case there is a written agreement then you have to proceed according to the agreement as there remains an arbitration clause in every written agreement. For submission of the claims before the arbitrator no court dee is required. In case you have to move to civil court then you can seek exemption from paying court fee by filing appropriate application under Order 33 Rule 1 of CPC.

Please file a case in Punjab State Consumer Redressal Commission , Sector 37 Chandigarh. The court fees is going to be very nominal in that, even less than 10K. So go ahead and hire a professional consumer lawyer to draft a strong case for yourself.

Do share the terms and agreement of the work as discussed between you the vendor and check if there is any specific clause of jurisdiction to file cases. A professional lawyer in consumer matters can save you a lot.
