Loan amount Recovery court fee

One of my friends, advanced a big amount against a idemnity bond executed on Rs.200 stamp value. Is it tenable, if we file a suit for recovery? What is the court fee per lakh?
Court fee is subject matter of states. In Karnataka court fee money recovery per lakh Rs. 4875/- for Rs. 75,000/- and 7 per cent of the amount exceeding Rs. 75,000/- but not exceeding Rs. 2,50,000/-. Regarding enforceability of indemnity bond, the contents of instrument need to be studied.

Hi Querist,
Yes you can file a case and recover the amount, if u dont have a cheque as security u can file only a suit for recovery of money.
If u hv a cheque then if the said cheque is bounced u can file a cheque dishonour case where there is no court fees, however in the case of suit for recovery of money the court fees to be payable will be approximately 6% on the balance outstanding amount. However it is advisable if u can issue a legal notice and give him time, inspite of it if he fails then u can proceed legally.
