Is tuition legal in India?

The RTE Act 2009, section 28, states that no teacher shall engage in private tuition or teaching activities. This bans all teachers. The Act only applies to government teachers. Private tuition is a problem that affects Indian education and needs to be addressed.

Based on the facts stated above, my opinion is as follows:

Apart from getting a license under the Bombay Shop and Establishments Act, there is no need to register your enterprise with any authority, provided you are not liable to pay GST.

If your gross receipts/revenue from the coaching/tuition fees is more than 20 lacs then you shall be liable to pay GST and you will have to get your enterprise registered.

Regards.
