23-Sep-2023 (In Labour & Service Law)
I resigned the company 3 months ago i have some existing problem and hold salary every time, They say salary & full and final settlement of previous employees are still pending and they will be considered first. Every time the HR gives some funny reason as if it's my concern that the previous cases are pending. an I send a notice to the company legally ? Is the company ignoring any law by delaying the fnf settlement.

How much of previous pendency is there with the company that is none of your concern. You should neither be bothered about it now your case shall get affected by it for any such reason.
The company is at its faultine by not paying you your due and by not relieving you with proper grace on paper.
You should send them a legal notice and if they fail to obey it then you should pursue this matter in competent court of jurisdiction along with the charges of mental harassment and agony.

Hi
will glad to help you. Send them a notice first demanding your due with interest. If they do not reply then file a case for recovery of money before the district court. It will be summary suit, if they have accepted their liability.

You are entitled to your rightful dues with interest. As a first action serve a legal notice on the employer. On reply or if no reply is given approach the district court for recovery of amount due. You will be required to pay court fees on amount so claimed.
