judicial help forHarassment of old parents by daughter and son in law

My elder sister is living with my parents and she is expecting too...my parents are retired and senior citizens. She along with her husband fights with my parents as she wants to keep her husband with her. They even not leaving my parents house....and they are forcefully living there. She yells at my parents and often abuse thm...tell me what can I do..I am living in abroad and can't go there becoz of covid situation...what can my parents do to save themselves from there torture.

Dear querist,

The best legal recourse in such situation is that since you mentioned that your parents are senior citizens. An application will be filed under section 4 of the senior citizens act, 2007 before the maintenance tribunal. Whereby, your parents will plead the eviction of their daughter and son in law on the grounds of mental harassment and ill behavior by them. You can be sure of one thing while the tribunal will give one chance to your sister and brother in law to either stop harassing your parents or to leave the house. An interim order will be prayed from the tribunal in the form of protection order which will ensure their safety and well being.

Since it is your parent's property then they can evict her with her husband from that property by sending a legal notice.(Being licenser and licensee)
Also your parents can file a police or court complaint against them under domestic violence act.

Your parents can always initiate proceedings under the Maintenance and Welfare of Parents and Senior Citizens Act, 2007 on the grounds of the mental and verbal abuse faced by them at the hands of your sister and her husband.
