Withdrawal of DV case by party itself as agreed in mutual consent

Mutual consent divorce is granted and agreed to withdraw the cases accordingly. Can the party directly go and withdraw the DV case ? As the lawyer is not supporting now to withdraw the case.

Yes, one party to the proceedings can withdraw the petition for mutual consent divorce at any time within the time period of six months given by the court. withdrawal can be done by filing of application in the court of law where the petition to obtain divorce was initially filed. The parties may obtain certified copy of mutual consent divorce decree and file a Memo for withdrawal before the DV Court along with the certify copy.

Dear Sir,
Yes, first ask your wife get issue a notice terminating the services of that Advocate or take NOC from him and engage another Advocate. Then file a memo stating that she is no more interested in the case and consequently it will be dismissed as withdrawn since it is a only summons case.
