What is the procedure to withdraw divorce petition (URGENT)
30-Jan-2023 (In Divorce Law)
Hi,
Can anyone please advise what is the procedure to withdraw divorce petition?
Also, do I need to appear before the court to dismiss the case or an application through my advocate would be enough to let the court know?
The status of the case is that it is still in initial filing status, and no hearing or processing/trial has happened.
it is a simple procedure. all that needs to be done is that an application for withdrawal of the case needs to be filed in the court where the divorce case is pending. you may be required to appear before the judge for withdrawal of the petition. however if there are special circumstances warranting your absence, the same may be communicated by your lawyer to the judge.
Can a divorce petition be dismissed?
The spouse who is being sued may counterclaim, contest the issues, and exercise his or her rights under law. The court can dismiss the case if neither party is involved in the case or if it does not progress. Parties can also agree to dismiss the case. 15-Dec-2021
Can divorce notice be taken back?
You can withdraw your petition. You can withdraw the petition at any time before first hearing or file a request to accept the matter in advance and then withdraw your application. The refund will depend on how the lawyer reacts to you changing your mind.
What is the procedure to cancel divorce?
You cannot reverse a divorce order that has already been granted. The parties can remarry as long as the marriage is solemnized and registered according to the Hindu Marriage Act.

Application through your advocate would be sifficient in the present case as divorce basically is the last resort which a court focuses on. Even if you don’t contest it for a long period it is deemed to be cancelled but go by the proper procedure and file an appropriate application before the trial court.
In India, a divorce petition can be withdrawn, but the procedure may vary depending on the circumstances and the stage of the divorce proceedings. Here is a general guideline for withdrawing a divorce petition:
It's essential to note that the withdrawal process can be more straightforward in cases of mutual consent divorce, where both parties agree to withdraw the petition. However, in contested divorce cases, the court's decision may be influenced by the circumstances and the interests of both parties.
Please consult with a qualified divorce lawyer who can provide you with specific advice and guide you through the withdrawal process tailored to your situation.
- Consult with Your Lawyer: If you've filed for divorce and wish to withdraw the petition, the first step is to consult with your lawyer. They will guide you through the process and advise you on the best course of action.
- File an Application for Withdrawal: You or your lawyer will need to file an application for the withdrawal of the divorce petition in the same court where the petition was originally filed. This application should state your reasons for seeking withdrawal.
- Court's Discretion: The court will review your application and may grant or deny the withdrawal based on the merits of your case. The court may also consider the consent of both parties in a mutual divorce case.
- Notification to the Other Party: It's important to notify the other party (your spouse) about your intention to withdraw the petition. They may have the opportunity to express their views on the withdrawal.
- Court Order: If the court is satisfied with your reasons and finds no legal impediments to withdrawal, it will issue an order allowing the withdrawal of the divorce petition.
- Record of Withdrawal: The withdrawal of the divorce petition will be recorded by the court, and the divorce proceedings will come to an end.
It's essential to note that the withdrawal process can be more straightforward in cases of mutual consent divorce, where both parties agree to withdraw the petition. However, in contested divorce cases, the court's decision may be influenced by the circumstances and the interests of both parties.
