Wife does not want to live with my parents,how to file a divorce case

Sir l m 32 yrs Hindu boy; married in April 2015 now have a two months old boy.My wife has been living with her parents since last one year.She doesn't want to live with my parents.l tried a lot but didn't get any response.They r disturbing my job as they r spreading romours at my working place.lt was a dowry free marriage.what will be the basis if l file a case.l m alone son n can't leave my parents.Can she file a dowry case?

yes you have a valid ground to file divorce case, even the hon'ble Apex court has recently held that incase a wife refuses to live with the parents of her husband, it amounts to creaulity As far as dowry case is concerened, yes she can file a dowry case, but incase you take preventive measures, like filing a petition for restitution of conjucal rights and a advance complaint to police,then the aftereffects of a dowry complaint would be lesser

Yes u can file the divorce petition on the ground which one u discussed in your query that she doesn't want to live with your parents because there is recently one judgement also of apex court on this very point. And abt dowry case, yes she can also file the do wry case againt u and your family

Sir, you have legal remedies under the law. You can file case for restitution of conjugal rights if you have not decided to get seperate from your wife. You can always take up your matter for mediation etc. You have to consult a lawyer personally to decide which option you want to take and the overshoot of the same.

Sir, you can file divorce on the same ground that she is not living in her matrimonial home since one year and living with her parents. She is not willing to continue with her married life.
Yes she can file a divorce case.
There is one more remedy, you can file a petition under section 9.

This query of yours is more of a psychology related and social in nature. Technically there are number of legal actions which can be initiated and it can not be predicted which one your wife selects.
