You cannot seek divorce under DV case. For that you need to file a separate petition. As far as maintenance and streedhan is concerned that can seek that also by filing an application for the same. Feel free to contact me seeking any further legal advice as regards the same.

Hi Good Morning, if you want maintainance, streedhan, and your belonging then you can proceed with Domestic Violence case against your husband and in laws, where you can claim all your things. If your husband approach high court for quash the FIR then you can deny and reject the quash application in high court. Even in Divorce case you can claim maintainance and streedhan, litigation fees also. for more querries and detail then contact us and visit our website.

You can seek partition under Hindu Succession Act. You can also seek for maintenance if you are a unmarried daughter or a minor son. Kindly share more facts and book a consultation call for detailed advice.

Divorce under DV case is not possible.
You can obtain divorce under Hindu Marriage Act (if you are Hindu by religion).

You can file an application under section 125 crpc for obtaining maintenance from husband. Alternatively, you can file a DV case against husband and then file application seeking interim maintenance from husband.

If you are willing to get mutual divorce, then in the consent terms, you must mention your condition of alimony amount & streedhan & litigation charges, before granting mutual divorce decree.
