If the case is filed by Husband , you will receive a summons of court about the case alongwith the copy of husband's Divorce Petition. You have to appear in court on the date mentioned in the said summons. Judge will ask you to appoint advocate and file written Statement as reply to the Divorce petition and if you are willing to give divorce , the contested divorce petition can be amended in mutual consent divorce petition with the consent of both of you.

Dear queriest, as per your query you have mentioned about the fact that your husband has filed divorce case and you are asking that if you will asked to give divorce for the first hearing itself, therefore it is suggested that it is not at all the procedure to decide the case in first date and yes you have to appoint an advocate to fight your case.

The date for the first hearing is set by either party. The court uses different mechanisms to try and ensure that the parties are able to communicate or mediate with each other, and that the marriage is not broken.
