Refusal to maintain wife. USA Bank Statement disclosure by court order

27-Apr-2024 (In Divorce Law)
My husband has a US bank account, while he has disclosed his statements for his Indian bank accounts he has declared he has no other account except the one in India. If I give the account number for his USA bank account, can the courts order him to present statements for them too?

yes. your husband is liable to give all details of his income and assets on affidavit. if he gives false information or suppresses any information which he is liable to give, court will not only direct him to disclose it, but it's a punishable offence too.

Yes you can always mention in the court through an affidavit that your partner is not disclosing his real assets and is liable to be prosecuted under section 199 r/w 191 and 193 and also under Section 209 of Indian Penal Code and the punishment can extend upto seven years. Yes, in India, the courts can order your husband to present statements for his US bank account.

The Hindu Marriage Act, 1955 under Section 25(4) empowers the court to ask either spouse to produce any document which it considers necessary for the disposal of the matter. This would include financial information like bank statements.

Yes as per the latest judgment of the Hon’ble Supreme Court if any spouse is concealing his or her real income or there is any dispute with regard to the disclosures in the Income Affidavit, than an application can be filed seeking directions to produce those documents

Yes. The courts can direct him to present statements from the US bank account. You may also file an application under section 340 crpc for falsely declaring and concealing the fact of his bank accounts.
