Dear AllI would like to know if the divorce petition filed by a husband rejected by the family court? I filed the petition on the grounds of the mental cruelty and sucide threat. I have evidences for both. If the petition gets rejected by the court due to wife's strong unwillingness for divorce, what should be my next step? should I have to live with the girl? Will the appeal work?
once a court after full fledged trial then it is the final degree once a good pose your final degree you have only remedy to appeal before the appeal Court in this matter it is a divorce case and the matter will come before the honorable High Court for appeal already evidence has been taken in the trial court and documents also be market before the court so on the basis of the evidence taken under the documentary proof the high court will see whether the petition is proved by the oral and documentary evidence are the petition is disproved by the respondent site and cities the better advice to make an apple before the honorable High Court

you need to Chek if the wife wants to live with you under the same roof.

If your petition for divorce gets dismissed you can very well go for appeal if there is any reason to do so. You cannot be forced to live with your wife. But your wife can claim for right to residence by filing appropriate petition before the court. If you have evidence to support cruelty and suicide threat then there is high chance that divorce may be granted.
