Clarification on grounds to file for divorce

I am 35 year old women married dated 4/12/2015. My husband works in dubai. He used to come india twice in year. But we not had any sexual relation as he given reason as we will start our relation once we live together since he is trying visa for Canada through me. But after some time his behaviour changed and he is avoiding contact me. In that time my sister and sister in laws ask me about our relation and i told them truth which my husband ask me not to tell.They done patch up as on nov 2017 as i want but now he is behaving same way. Now my patience are over i want divorce but nobody with me as they think i am telling lies since i disclose truth after 2 year. Do not know how do i prove truth.

उन्हें घरेलू हिंसा अधिनियम के तहत केस दर्ज करना चाहिए और गुजारा भत्ता के लिए न्यायालय से प्रार्थना करनी चाहिए। तलाक बाद का विकल्प है। पहले पारिवारिक न्यायालय में सुरक्षा और संरक्षा तथा गुजारा के लिए पति और उसके परिवार को पार्टी बना कर केस दाखिल करे।

one suit has to be filed for maintenance in family court in your respective district, There is provision in section 125 for maintenance of wives,parents and children. on local ground you can advice through family court.

You can do the following:
1. You should collect evidence of your marriage;
2. Do you have marriage certificate?
3. You can then collect the photographs of your marriage;
4. Collect evidence of travel of your husband;
5. You can file a petition for divorce in the jurisdiction of your court;
6. You can state in the petition all the reasons for filing of the divorce;
7. All the above mentioned evidences can be used as circumstantial evidence to prove that your marriage was not successful one;

Dear Querist, looking at circumstances it appears that you have decided to file a divorce petition. Then it is suggested better sit and discuss with all your family and husband's family, whether a mutual consent divorce can be filed. So that issues can be sorted out fast.

Dear client,
Your friend can not file petition for divorce till he complete one year of his marriage. As on today he can fille petition for annulement of his marriage within one year of his marriage. Always be matured and do not spoil life of yours and your partener and entire family.

In this case there is a bar of divorce petition under the law i e you cannot go for divorce within one year

However if this marriage is performed under force or fraud then it can be nullified

Your friend has unnecessary wasted the life of a woman by doing this it will be better 2 go ahead and pursue the marriage . Unnecessary taking divorce for no reason not good for the social fabric of our society

This is not a ground for Divorce. Petition for Divorce can be filed after expiry of one year of marriage.
Before one year or within one year, the MARRAIGE can be annuled and can be declared viodable.
But in your friends case I don't think this can suit for annulment or for filing a petition for viodable MARRAIGE as family pressure is not a ground for viodable MARRAIGE.
Your friend was well aware and also knowing whom he is marrying so there was no fraud or misconcealment of fact at the time of MARRAIGE. He was not forced ,he was only pressurised as he is above 21 years of age he had a right to say no to the marraige. I don't think your friend has any valid reason for annulment of marraige or even Divorce.

hi according to your query if your wife date is below 18 years you can file a divorce petition in the family court to pass a orders on which the marriage is happened on 2nd may 2018 as null and voidable marriage for further clarification in your case you can contact us at any time.

yes, there is chance to apply for your marriage was null and void , it is not divorce. your marriage is done with fraudulent in nature by suppressing the date of birth and also cheated you on that ground you have to file case. cont.advocate

You can file for divorce on the ground of cheating and she is underaged for marriage. Please issue a legal notice to her with all the facts. Wait for her reply and see whats her reply..keep a copy of Adhav and SSC markslist...for court purpose
