Solution against the high court instruction

04-Nov-2026 (In Divorce Law)
My wife filed case against me and parents under 498a,504,323,506,3/4 and DV in 2016 in Aligarh which I got bail and stay for parents from Allahabad high court. in 2017 through court mediation I brought back my wife and since than living with me. I submitted the compromise copy to high court in which they ordered in Sep 2022 verify the compromise with your wife and parents in lower court there is not time limit given in order. So wife is not cooperating to verify the compromise. Now what to do?

file an SLP before the Hon'ble supreme court challenging the Hon'ble high court's directions and abuse of the process of law by your wife. pray for the grant of divorce from the Hon'ble supreme court on that basis itself. You have good chances of getting divorce.

You may file an application before the Allahabad High Court seeking appropriate directions for implementation of its September 2022 order. The wife's non-cooperation can be brought to the Court's notice, along with the mediation settlement and proof of subsequent cohabitation. You may also seek clarification or modification of the earlier order, as advised by your counsel. The matter should not be left pending indefinitely.

We would need to examine the Allahabad High Court order dated September 2022, the compromise agreement recorded during mediation in 2017, and the current status of the criminal proceedings. Since your wife is presently residing with you but is not cooperating with the verification of the compromise, we can examine the appropriate legal remedy, including placing the subsequent developments before the High Court and seeking appropriate directions for further proceedings. Please share the High Court order, the compromise documents and the latest status of the cases pending before the lower court. After examining the documents, we can advise you on the appropriate legal course of action. Regards, Himanshu Sharma Advocate VIGILANT LEGUM LAW FIRM Delhi
