Q: redevelopment Agreement with builder is it RERA or Small cause?

Hi there  I was staying with my family in a pagadi system flat with area approx 400 and paying rent of 550/- per month in Mumbai.Now BMC has demolished the building due to dilapidated condition  Land owner/ Builder wishes to continue pagadi post redevelopment and not ownership Landlord even after 3 legal notices reminders have not come forward to execute any agreement nor given any compensation for PAA.The CC of the building is already given by BMC last monthI need to know for agreement with builder where to approach is it RERA or Small causes court?

Dear Querist?You will have to file declaratory suit, in Small causes court for declaration that you are the tenant of Landlord. Only difficulty is if you have have handed over the possession without any documentation then, it will be difficult for you to seek declaration.



Q: Rent not paid nor lease renewed

Our property was leased to Reliance Communications, which is now bankrupt. the lease expired in 2018, but they haven't vacated our property nor renewed the lease nor paid any rent and are not responding to our calls/emails. We are not able to use our own property due to presence of their equipment. What can we do in this case? Can we sell their equipment off?

Dear Querist, for what purpose the premises was given to Reliance Communications commercial /residential?.If residential then you need to file case before Competent Authority, bandra and if commercial then Small causes court. Please check whether Reliance Communications is in Insolvency or liquidation. If yes, then you have to file claim for the rent.Regards,Rakesh V. Misar



Q: Leave N License Tenant Agreement Tenure

I have a tenant staying in my flat from last 7 years. We enter into registered agreement every 2 years legally. Is it wise to continue with the same tenant for more number of years and would he can cause any problems for me in future. We would be doing registered agreement for any further L&L if I plan to renew.

1.We are contractor in Railway but some issues Payment and Recover means penalty and some other issues such as Contract Termination2. An tender baipass and awarded to 3rd Lower but we are fullfill Eligibilty as per Notice of Tender.

Hello , My father made lease aggreemet to put petrol pump on land , now I want to cancel this agreement. please guide me for procedure.

You have not mentioned why you want to cancel, whether the lesee has violated any terms and conditions. If there is any violation then you can terminate the contract and claim possession. And if not the lessee doesnt give possession then file suit in court.
