can only husband close dowry case after getting divorce

my wife has filled dowry case in 2015. we file seperate 13b divorce case and got divorce in 2019. But dowry case is still running. can i get this case close on behafe of divorce degree without exwife consent

If both of you have gone through a mutual consent divorce then there’s no point of the DV case to continue. You can always file a application with the magistrate who was listening your DV case. And it that your wife will give a written statement that her case be closed.

Share the court’s order and all the applications and replies filed yet. I will go through all the documents and then suggest what would be the best course of action and which court you should move to get the decree.

I am afraid that is not possible sir. This should’ve been done at the time of mutual consent divorce only. But you may go for quashing of the same based on the fact that you both have mutually separated. It would simply amount to trying your luck before the high court. But you should go for it.

If the marriage has been dissolved on mutual consent then the other proceedings can be quashed. You would require to present before the court with the decree and apply for the quashing. For any further legal assistance please feel free to contact

No, the dowry case can only be withdrawn by your wife and the same should have been done at the time of the mutual divorce before second motion.

Now the only resort left in your hands ia to file a quashing in the high court and take your chances, on the basis that the matter between both the parties have been settled amicably and the continuation of the said case would put accused to great pressure and prejudice.
