Questions Answered by Advocate Bhawana Pandey
Q: Brother in law has taken all properties
My father in law died in 2015 and he had five children, two sons, three daughters. My elder brother in law asked me and and my husband to leave the house and got hold of all properties since FIL didn't leave any will. Now my husband is no more and I want to claim a share in my FIL's properties. How can i do that since I do not have any documents of any of those properties. Thanks.
Advocate Bhawana Pandey answered
If your father in law died intestate and without any will, then you can claim your share in the property after the death of your husband. We can file civil suit for partition in court to claim your share. For any further clarification feel free to contact. Thanks
Q: Emotional abuse by husband. I have doubt of extramarital affair of him
My husband never shares or discusses anything with me. He verbally abuses me a lot of I counter him for his behaviour. Even if I crack a joke or try to be funny, he gets angry and starts fighting and abusing. He is not even ready to purchase a flat or do anything to secure my life. We live in a rented house from last 14 years. He talks well to his family and our only child. I am the only person he ignores. He doesn't even bother if I cry, get I'll or I stop talking to him.
Advocate Bhawana Pandey answered
The situation expressed by you in your query, tantamount to mental cruelty and the same is a ground for divorce as per Hindu marriage act. If you wish to proceed for divorce, materials to substantiate the allegations would be needed. For better understanding feel free to contact Thanks

I sold my property to builder for which deal was done for 1.5 cr. He got us signed 2 agreements one in which he mentioned full amount nd second in which he mentioned rs 50 Lacks ( which he will do for registery) would like to mention I had received only 10 Lacks as of now now he is asking me to reduce price My questions is As it's not registerd yet only agreement signed can I cancell agreement He is also giveng us threats to not to go to our property as he will ask his goons to beat us hel
Advocate Bhawana Pandey answered
The builder can file for execution of the agreement to sell or the other agreement which has reduced amount as both bears your signatures. However, if the issue is only limited to money, you can demand the promised amount as per the agreement. Yet if the decision is to revoke the deal, it is suggested to file civil suit for cancelation of the agreement. Terms of agreement need to be perused for better advice. Feel free to contact. Thanks
Q: Drafted and recorded by opposing counsel a fraudulent property deed
How to put a stay on a partition of property and file a lawsuit for property fraud?
Advocate Bhawana Pandey answered
You can file a suit for partition if you hold your valuable legal right in the same property. However evidence needs to be perused to file it before. If there is any apprehension on the status of the property to be disturbed then stay can be granted by the court immediately. For any further clarification feel free to contact. Thanks
