Q: Tenant staying in my house for more than 20 years - Rights
I'm a NRI based, house in Delhi rented for the last 20 years with the same tenant, got a 11 month agreement renewed every year. My agreement is of Rs.50 stamp paper of Govt of National Capital Territory of Delhi. My question is, since the tenant is staying there for last 20 years, can tenant claim rights to the property, how can I safeguard my interests as a Landlord with same tenant, is there any additional clause in need to add in the agreement specific to state Rent Control Act. If the tenant is paying the rents on timely basis and there is a rent agreement made and notaried or registered as per law, it shall not create any hindrance to your ownership rights. However it is advisable to get an Agreement drafted inserting requisite clauses restricting the rights of the tenant in changing the nature or status of the property so that no further legal issues arise. Q: Someone tries to grab our land via adverse possession law
My step grandmother lent a agricultural land for one time payment of rupees 7k around 1995 and whenever we repay that money he will return that land to us. Now there is not as such any agreement for this. And that person having criminal history so no one will come out to in our favour and now he tries to pull us in order to adverse possession case bcz its been more than 28 yrs.
