Hi, Me and my family members are accused in 498a and 406 IPC, which was given falsely by my brother wife. She is from kerala and we are from Nilgiris tamilnadu the case is registered and we are about to receive the summons from their court for appearance we have taken the anticipatry bail. Id like to know if i can file writ petition in my district court where I reside for exemption my parents from attending the court as he is a senior citizen and my mother is also aged, I and my brother we'll attend the court without fail. Please advise

You can file appropriate petition to dispense with the appearance of aged parents after making first appearance. Simultaneously, you can file quash petition before the high court to quash the proceedings.

In this case, you con’t get exemption for attending court but you people file a petition for quashing the FIR before High court and further if the court is satisfied that your parents is falsely implicated and FIR is bogus and frivolous. dispensation petition to be filed at high court of the state for exemption of your parents from appearing in court. you have not mentioned in which state court the case is filed kerala or Tamilnadu.
