Maintenance and welfare of senior citizens act

(son ) and wife staying in house jointly owned by father and mother (50.50) Father has deserted mother and staying separately for past 3 years. Paying no maintenance to mother. . Now father has filled application infront of SDO , mumbai for maintenance of 10 thousand and eviction of me (son) and my wife . Father is well to do and has lot of money in bank . Mother is with me (son) and my wife ... she is against father and also against this application . How do we protect ourselves from misuse of this act for harassmrnt and our protection... Can DV act be of help for daughter in law as per recent Supreme court judgement Also important point is that father is only joint owner of property and mother has no complaints. I also have a sister who is married Plz sugggest legally how i can protect my interests...

Sorry to know about your situation. As you mentioned if the house is jointly owned by your father and mother then eviction of your mother from the house is not possible as she too is a owner and therefore you will have to contest the case.
